Welcome to AbleToPlay, a service provided by Good Trouble Games Inc. ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of AbleToPlay's website, services, and applications (collectively, the "Service").

1. Account Creation and User Information

3. Accessibility Profile and Game Recommendations

  1. You acknowledge that community-sourced information may appear on the Service, and that Good Trouble Games Inc. makes no guarantee of the information provided on the Service.
  2. You acknowledge that without accurate information in your profile, your experience and recommendations may have impacted quality.
  3. The information provided on the Service is for informational purposes only and does not constitute professional or medical advice.

4. Data Collection and Analytics

We may collect, analyze, and use anonymized data regarding user interactions with the Service, including usage patterns, feature utilization, and performance metrics. Such data collection helps us improve the Service and may be used for business analytics purposes.

5. Prohibited Uses

You agree not to use the Service:

  1. In any way that violates applicable laws or regulations.
  2. To impersonate others.
  3. For unauthorized commercial purposes
  4. To collect, harvest, or scrape content or information from the Service.
  5. To train, develop, or improve any artificial intelligence system.

6. Data Usage Restrictions

6.1. Prohibited Commercial Use of AbleToPlay Data

Users and third parties are expressly prohibited from using data, content, or information obtained from the Service for commercial purposes without explicit written permission from Good Trouble Games Inc.

This includes, but is not limited to:

  1. Incorporating our accessibility data into commercial products or services.
  2. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive our proprietary methodologies, algorithms, system architecture, categorization frameworks, or assessment criteria regardless of purpose or intent.
  3. Reselling or redistributing our data in any form.
  4. Using our data to create competing services, or integrating our data into any other service.
  5. Displaying our data on other platforms, including digital storefronts, game launchers, or commercial websites, without our express written consent.

Any commercial entity wishing to utilize AbleToPlay data must first contact us to negotiate appropriate licensing terms.

6.2. Data Mining and Automated Access

The use of bots, crawlers, scrapers, or other automated tools to access, collect, use, stream, or download data from the Service is strictly prohibited without our express written consent.

Systematic, automatic, or programmatic collection of data from the Service, regardless of method or purpose, is not permitted.

AI Agents, AI Bots, or other similar AI systems are not permitted to access the Service without first obtaining our express written consent and must be individually licensed and approved by Good Trouble Games Inc.

6.3. Enforcement

Good Trouble Games Inc. reserves the right to take appropriate legal action against any party found to be using AbleToPlay data for prohibited commercial purposes or engaging in unauthorized data mining.

Users agree that violations of these restrictions, in part or in whole, constitute a material breach that may cause irreparable harm to our business, intellectual property rights, and competitive position that cannot be adequately compensated through monetary damages alone. Accordingly, users acknowledge that Good Trouble Games Inc. shall be entitled to seek injunctive relief in addition to any other remedies available at law or in equity.

Users further agree that any prohibited use of our data represents unjust enrichment, and Good Trouble Games Inc. may seek disgorgement of any profits derived from such unauthorized use, in addition to statutory damages where applicable.

7. AI Training and Machine Learning Restrictions

7.1. Prohibition on AI Training

Users and third parties are expressly prohibited from using any content, data, or information obtained from the Service to train, develop, fine-tune, or improve artificial intelligence, machine learning models, or similar technologies.

This prohibition applies to all forms of AI systems, including but not limited to:

  1. Large language models
  2. Recommendation engines
  3. Data analysis systems
  4. Accessibility evaluation tools
  5. Game recommendation systems
  6. AI Agents, AI Bots, or other similar autonomous workflow systems

7.2. Consent and Licensing

Any party wishing to use AbleToPlay data for AI training or machine learning purposes must first obtain explicit written consent and a signed and fully executed licensing agreement from Good Trouble Games Inc.

7.3. Enforcement

Good Trouble Games Inc. reserves the right to take legal action against any party found to be using AbleToPlay data for prohibited AI training purposes.

Users agree that violations of these restrictions may cause irreparable harm that cannot be adequately compensated through monetary damages alone. Accordingly, users acknowledge that Good Trouble Games Inc. shall be entitled to seek injunctive relief in addition to any other remedies available at law or in equity.

8. Intellectual Property

  1. The Service and its original content remain the exclusive property of Good Trouble Games Inc. and its licensors.
  2. Good Trouble Games Inc. reserves all rights to the Service and its original content.

  4. Third-party content (e.g., game screenshots, names, logos) is the property of its respective owners and is used for informational purposes only.
  5. All games shown on the Service are trademarks and copyrights of their respective owners.
  6. Users are prohibited from using any third-party intellectual property displayed on the Service for commercial purposes.

9. Account Termination and Suspension

  1. You may request account termination at any time.
  2. We reserve the right to terminate or suspend accounts for violations of these Terms or after extended periods of inactivity.
  3. We may terminate, ban, or suspend accounts without prior notice, at our discretion.

10. Service Updates and Notifications

  2. We may change the functionality of the Service without advanced notification.

11. Limitation of Liability

We are not liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service, including loss of profits, data, or goodwill.

12. Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

13. Governing Law and Dispute Resolution

These Terms are governed exclusively by the laws of the State of Delaware.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute"), the parties shall first attempt to resolve such Dispute through good-faith negotiations before pursuing arbitration. Either party may initiate arbitration if the Dispute remains unresolved after thirty (30) days from when the Dispute was first raised.

If the Dispute cannot be resolved through negotiations, it shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

The arbitration shall be conducted by a single arbitrator, and the arbitration proceedings shall be held through online communications.

The arbitrator's decision shall be final and binding, and judgment on the award may be enforced by any court with legal authority to do so.

You agree to resolve any Dispute on an individual basis and waive any right to pursue a class action, consolidated, or representative proceeding.

14. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Any changes to the Terms will be effective immediately upon posting the revised Terms on the Service. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of such changes.

15. User Contributions and Feedback

15.1. User Contributions

We highly value and actively encourage user participation in improving and expanding the AbleToPlay platform. This includes, but is not limited to:

  1. Providing feedback on the Service's features and functionality
  2. Suggesting improvements or new ideas for the platform
  3. Submitting missing data for games in our database
  4. Providing corrections or updates to existing game information
  5. Sharing personal experiences related to game accessibility
  6. Offering comments on the accuracy and helpfulness of existing accessibility information

15.2. Submission Process

You may submit your contributions and feedback ("Submissions") through various channels provided within the Service, including but not limited to:

  1. Dedicated feedback forms
  2. Game-specific data submission forms
  3. User forums or community spaces such as Discord
  4. Direct communication channels specified by AbleToPlay

15.3. Use of Submissions

To enable us to effectively utilize your Submissions to improve and expand the AbleToPlay platform for the benefit of the entire gaming community, you acknowledge and agree to the following terms:

  1. Any Submissions you provide to us will be considered non-confidential and non-proprietary.
  2. By submitting your contributions, you grant AbleToPlay a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, and perpetual license to use, modify, reproduce, distribute, and publish these Submissions.
  3. This license allows us to incorporate your Submissions into our Service, to improve our game database, and to enhance the overall user experience of the AbleToPlay platform.
  4. We may use these Submissions for any purpose related to improving and expanding our Service, including but not limited to updating our database, enhancing our algorithms, and featuring selected contributions in our user interface or promotional materials.

15.4. Recognition and Community Contribution

While AbleToPlay is not obligated to provide compensation for Submissions, we deeply appreciate and value your contributions. We may, at our discretion, implement various forms of recognition for active contributors, such as:

  1. Publicly acknowledging significant contributions
  2. Featuring top contributors on our platform
  3. Providing special badges or status indicators for active participants
  4. Offering opportunities for increased involvement in the AbleToPlay community
  5. Offering longstanding and high-qulity contributors the potential for freelance opportunities to perform games research and testing

15.5. Prohibited Submissions

You agree not to submit any content that is illegal, offensive, or violates the rights of any third party. AbleToPlay reserves the right to remove or refuse to publish any Submission at our sole discretion.

15.6. No Obligation

While we greatly appreciate all Submissions, AbleToPlay is under no obligation to use, implement, or respond to any Submission received.

16. Paid Testing Opportunities

You may apply for paid testing opportunities through the appropriate form on the Service. Submitting an application does not guarantee employment or paid work, and we are under no obligation to offer paid work to any applicant. Applicants selected for further consideration will be required to accept additional terms and conditions, including age requirements, residency restrictions, and confidentiality agreements, before proceeding with any testing-related engagement, opportunity, or offer.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Any such provision shall be deleted without affecting the remaining provisions herein, and the unenforceable or invalid provision shall be replaced with an enforceable and valid provision that best reflects the intent of the original provision.

18. Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without our prior written consent, but may be assigned by Good Trouble Games Inc. without restriction. Any attempted transfer or assignment in violation of this section shall be null and void.

19. Construction and Interpretation

The headings, formatting, and organizational structure contained herein are inserted solely for convenience of reference and shall not constitute a part of these Terms, nor shall they affect the meaning, interpretation, or effect of any provision hereof. No provision of these Terms shall be construed against the drafter of these Terms. Any enumeration or list following the term "including" or similar expressions shall be deemed to be without limitation and shall not be construed to exclude other items not specifically enumerated.

By accessing or using AbleToPlay in any manner, you acknowledge that you have read, fully understood, and agree to be bound by these Terms of Service in their entirety. Your continued use of the Service constitutes ongoing acceptance of these Terms, including any future amendments. If you do not agree to any part of these Terms, you must immediately discontinue use of the Service.
